The All Progressives Congress (APC) in Osun says it will appeal the tribunal judgment that declared Sen. Ademola Adeleke of the People’s Democratic Party (PDP) winner of the September 2018 re-run governorship election in Osun.

Mr Kunle Oyatomi, the APC Director of Publicity, Research and Strategy, said in a statement on Friday in Osogbo that the verdict would not stand superior legal scrutiny.

“We are going to appeal the judgment.

“The verdict cannot stand superior legal scrutiny. Therefore we will appeal against it,” Oyatomi said.

The PDP in the state, however, commended the judiciary on what it called a landmark judgment.

Mr. Soji Adagunodo, the Osun PDP Chairman, in his reaction, said the victory was for the people of the state.

Adagunodo said the judgment shows that “we still have men of impeccable character in the judiciary.’’

” Kudos to the Nigerian judiciary and this shows that we still have men of impeccable character in the judiciary.

The News Agency of Nigeria (NAN) reports that the Osun State Governorship Election Petition Tribunal sitting in Abuja had on Friday declared Adeleke winner.

The three-member panel said during its ruling that the rerun election that held on Sept. 27, 2018, was illegal.

The tribunal, therefore, deducted the votes scored by the APC candidate, Gboyega Oyetola, in the rerun after declaring the rerun illegal.

The tribunal said Adeleke won the election at the first ballot on Sept. 22 and the rerun that INEC devised to reach a final conclusion a week later was illegal.

“The declaration of Oyetola is null and void,” the tribunal ruled in a majority decision with one member dissenting.

BREAKING: Tribunal Declares Ademola Adeleke Winner Of Osun Governorship Election

AgegePulse Magazine

The Osun State Governorship Election Tribunal has declared the candidate of the Peoples Democratic Party (PDP), Senator Ademola Adeleke, as the winner of the poll.

The Tribunal made the declaration on Friday after dismissing a preliminary objection against the petition of the PDP and Senator Adeleke, challenging the September 2018 governorship election in the state.

The preliminary objection was filed by the All Progressives Congress (APC) and its candidate in the election, Governor Gboyega Oyetola, as well as the Independent National Electoral Commission (INEC).

The three defendants claimed that the petition of the PDP and its candidate was incompetent and the tribunal lacked jurisdiction to hear it.

Delivering a ruling on the preliminary objection, Justice Obiora Obi who is a member of the three-man Tribunal held that the petition was competent.

He also stated that the Tribunal has the jurisdiction to hear and determine it.

The judge held that there was merit in the appeal filed by the PDP and Senator Adeleke, adding that the declaration and return of Governor Oyetola by INEC was null and void.

He, thereafter, declared Senator Adeleke, who represents Osun West district in the National Assembly, as the winner of the election and duly elected governor of the state.

The tribunal also held that the Certificate of Return issued to Governor Oyetola be withdrawn and that a fresh one should be issued to Senator Adeleke of the PDP, having fulfilled the conditions of the law.

It said the petitioner scored the lawful majority votes at the election while the rerun held in the seven cancelled units were null and void and of no electoral effect.

The PDP and Senator Adeleke had approached the Tribunal to challenge the declaration of Adegboyega Oyetola of the APC as the winner of the September 22, 2018, election by the electoral body.

After entertaining final arguments and adoption of written addresses by lawyers to the parties involved on March 7, the Tribunal announced that it would reserve judgment on the matter.

The Tribunal, which was earlier sitting in Osun, was relocated from the High Court of Justice Complex, Osogbo to Abuja in November 2018.

Sports: MFM's Alli showers encomium on players for brave performance in Katsina

AgegePulse Magazine

Mountain of Fire and Miracles Ministries FC assistant coach, Alli Suleman Obinna has showered praise on his team after their 1-1 outing against Katsina United on Wednesday.

Alli Suleman, who led the team to Katsina in the absence of head coach Fidelis Ilechukwu, who is on national assignment with the Nigerian Olympic team showered encomium on the players for their worthy performance in an interview with MFM FC Media.

“First and foremost, I want to thank God Almighty because Katsina is not an easy place for us to play and get what we have got.

“I really want to applaud the boys for the way they approached the game and at the end of the game we got the one point notwithstanding we still need to prepare and forge ahead for the remaining matches so that we can be in a better position at the end of the season,” he said.

MFM FC were forced to a 1-1 draw to extend their lead in Group A  with six points in a rescheduled fixture of Matchday 9 of the Nigeria Professional Football League (NPFL) decided at the Muhammadu Dikko Stadium.

The hosts dominated the larger part of the first 45 minutes of the proceedings with several attempt on goal and precise attacking moves but MFM FC goalkeeper Folarin Abayomi  stood his ground and made series of saves.

Katsina United were awarded a penalty in the 17th minute of the game when Abisoye Olawale mistakenly handled the ball in his box. Destiny Ashadi stepped up and took the spot kick but Folarin denied him after a big save.

The Changi Boys had a chance to score the first goal on the half hour mark off a nicely executed free kick taken by Ashadi but his attempt and a rebound from Martins Usule hit the cross bar.

With one minute to wrap the first half, Chijioke Akuneto raced on to a lovely pass from Elijah Akanni who had earlier initiated a move from midfield and put the ball beyond Dami Paul with a screamer from way out.

The hosts drew level in the 70th minute of the exchange through Usule's close range finish. Katsina United made several attempts to score the second goal but the youthful MFM side thwarted all their moves.

The Olukoya Boys maintain top spot in Group A of the NPFL standings with 22 points from 11 league matches.

Breaking: FG closes case against Onnoghen after 3 witnesses

AgegePulse Magazine

By Ikechukwu Nnochiri

The Federal Government, on Thursday, closed its case against the suspended Chief Justice of Nigeria, CJN, Justice Walter Onnoghen, after it produced only three witnesses that testified before the Code of Conduct Tribunal, CCT.

Suspended Chief Justice of Nigeria (CJN) Justice Walter Samuel Nkanu Onnoghen Though FG initially expressed its intention to produce a total of six witnesses to substantiate all the allegations it levelled against the embattled CJN, however, shortly after the third witness was discharged, the prosecution counsel told the tribunal that it would be unnecessary to call further witnesses.

The prosecution counsel, Mr. Aliyu Umar, SAN, told the tribunal that the defendant was at liberty to summon any of the listed but uncalled witnesses to testify on his behalf if he so wished. He was immediately overruled by the CCT Chairman, Mr. Danladi Umar, even as Onnoghen’s lawyer, Chief Adegboyega Awomolo, SAN, rejected the offer.

“This is the case of the prosecution. If it feels that it is satisfied with evidence of the three witnesses, then so be it”, the CCT Chairman held. Thereafter, Awomolo told the tribunal that the CJN would in line with section 303 of the Administration of Criminal Justice Act, ACJA, 2015, enter a no case submission with respect to all the allegations FG levelled against him. Awomolo, therefore, applied for record of proceedings of the tribunal to enable his client to file the necessary processes.

The case was subsequently adjourned till next week Friday for hearing of the no-case application by the embattled CJN, as well as for adoption of the final written addresses. Earlier in the proceeding, the third prosecution witness, PW-3, Mr. Ifeoma Okagbue, a staff of Standard Chartered Bank in Abuja, told the tribunal that it was not true that the defendant possessed either $1million or £1million in any of the five bank accounts that necessitated the charge. Okagbue who told the tribunal that she started managing Onnoghen’s bank accounts since 2015, gave a load down of both the opening and closing balance of all the accounts from January 2018 to January 2019.

She said the accounts were all linked to one Bank Verification Code, BVN, adding that the bank had upon securing an approval from the defendant, diverted funds from the accounts into various profit yielding ventures. The PW-3 told the tribunal that profits that accrued from the investments were credited back into the accounts. While two of the accounts are in Naira, the three others were Pounds Sterling, Euro and Dollar accounts. The witness told the tribunal that all the accounts were domiciliary, and were opened and managed at the branch of the bank in Wuse 2, Abuja.

Before Mrs. Okagbue mounted the witness box, the PW-2, who is a retired Director at the Code of Conduct Bureau, CCB, Mr. Awal Yakassai, told the Mr. Umar led three-man panel that contrary to what was alleged in the media, he said the suspended CJN owned only five houses.

He said it was not true that CCB investigators linked the ownership of 55 houses to the defendant. The witness made the disclosure after he was shown copies of Justice Onnoghen’s asset declaration forms, which the Federal Government tendered in evidence before the CCT.

The embattled CJN was said to have submitted the forms marked as Exhibit 2 and 3, to the CCB in 2014 and 2016.

Answering questions under cross-examination, the PW-2, told the tribunal that he served at the CCB for 29 years before he retired in April 2018. He admitted that the CCB was yet to verify Justice Onnoghen’s assets with a view to finding out if he made false declarations. Aside allegation that he failed to declare his assets as prescribed by the law, FG had in the charge marked CCT/ABJ/01/19, FG, alleged that Onnoghen operated five foreign bank accounts, contrary to section 15(2) of Code of Conduct Bureau and Tribunal Act.

FG had insisted that it was the CCB that okayed Onnoghen’s trial based on certain infractions that were discovered in his asset declaration forms.

Trending: Olatoye Sugar's Family Demands N200m Damages From UCH

AgegePulse Magazine

The family of the late lawmaker, Temitope Olatoye (aka Sugar) has petitioned the University College Hospital (UCH), Ibadan, for the alleged sharing of the deceased’s ‘horrific’ photographs on social media without its approval.

It is seeking N200 million damages.

In the petition by C. C. Amedu of Ikeh Sunday Chambers, Ibadan,  the Olatoye family accused the hospital of allowing the gory photographs of the late lawmaker in his dying hours at the Intensive Care Unit (ICU) of the hospital to be circulated on social media, thereby causing members of his family a lot of grief.

The petition was also sent to the Minister of Health and the Ibadan chapter of the Nigerian Medical Association (NMA).

Although the family acknowledged that doctors and other workers attending to the late Sugar declared in the presence of Sugar’s family that taking photographs of patients was prohibited, they were surprised to see such photographs circulating on online newspapers and social media hours later.

They insisted that the ICU of a hospital is a restricted area, hence only members of staff of the hospital had access to the dying Olatoye.

They reminded the UCH management of the Hippocratic oath, ethics and international best practices in the medical profession, which protect the rights of a dying patient to die in peace and dignity, which also mandates doctors to maintain respect for human life, avoid using their privileges as doctors to violate human rights, which also mandates them to practise the profession with conscience and dignity.

In spite of the ethics, the Olatoyes said it was disheartening that UCH staff allegedly allowed the taking, circulation and publication of the dehumanising photographs of the deceased, which have since been trending online.

The petition reads in part: “A cursory assessment of the attached photographs revealed that the deceased, as at the time the photographs were taken, was still at the Intensive Care Unit of the hospital in a pool of blood. Therefore, it is reasonable and unarguable to believe that only your staff could access the unit at the material time.

“The above conduct of your staff suggested that instead of your personnel on duty to have acted in their full professional capacity, focusing on taking care of the deceased, which might have probably saved his life, they were busy taking his pictures, which perhaps for the purpose of selling same to social media operators as it can be seen trending online.”

They posited that the trending online photographs have been serving as a painful reminder to Sugar’s gruesome murder, adding that they also subjected members of the family to “a lasting unimaginable depression, mental and psychological torture.”

By GEORGE OKOJIE

AgegePulse Magazine

The Lagos State Government on Monday debunked rumour making the rounds in the state that a building on 57 Egerton Square, Oke Arin on Lagos Island collapsed with people trapped.

The state government trending reports online, including videos that another building had collapsed on Lagos Island is coming on the heels of a three storey building that killed 20 pupils and an adult in Lagos Island.

The General Manager, Lagos State Emergency Management Agency, (LASEMA), Adesina Tiamiyu while debunking that no building collapsed on Lagos Island said what happened was that officials of the Lagos State Building Control Agency, (LASBCA), were demolishing the building on Egerton Square and that a scavenger got injured while trying to pick up something from the building.

Also, LASBCA officials who were at the scene said there was no collapsed building and that they were pulling down a structure when a scavenger tried to pick up something and was injured.

LASBCA Public Affairs Officer, Titi Ajirotutu denied that a building collapsed on Lagos Island, saying that the building was under demolition and that one person who was trying to pick up something from the building was seriously injured, while dismissing various online reports of a collapsed building.

However, an eye-witness who craved anonymity said the building did not collapse on its own, but that it was being demolished.

Corroborating LASEMA boss, the Director of the Lagos State Fire Service, Rasaki Musbau said he learnt that there was a demolition ongoing on the Island.

‘How we escaped death’ — Nigerian-born imam speaks on New Zealand attack

A Nigerian Imam, Alabi Lateef, a who saved several lives during the New Zealand terror attack, has broken his silence about the massacre.

Lateef was at the Linwood mosque in Christchurch on March 15, when gunman, Brenton Tarrant, opened fire on worshippers killing at least 7 people, after already killing 42 people at the Al Noor mosque.
At the Linwood mosque, worshippers were about to drop to the floor for the second part of the prayer service, when Lateef spotted the gunman.
Hearing gunfire outside, the Imam shouted ‘go down’, warning the worshippers to take cover.
In a chat with The New Zealand Herald, he said: “When I saw those Muslims shot dead, I just told our brothers, ‘Go down! Go down! Somebody has just shot our brothers outside the masjid.
No one listened to me until unfortunately he came from behind and he shot one of our brothers in the head through the window. He saw him standing and shot him through the window. .
When glass got broken and the brother fell down, everyone realised to go down.”
The Imam rushed outside with fellow worshipper, Abdul Aziz, who picked up a credit card machine on his way.
Aziz told NZ Herald that he threw the machine at the gunman, who was running back to his car to get another weapon. The terrorist responded by firing at Aziz, who ran through a sea of parked cars to escape the bullets, picking up a discarded gun.
Squeezing the trigger, Aziz realised it was empty, so he hurled it at the gunman’s car.
Jumping into his vehicle, the terrorist made a u-turn and sped away.
Lateef, who had locked the main door of the mosque to keep those inside safe, then called the emergency services, also doing his best to help those wounded. He added he had been prepared to die to save his people:
“I can’t believe… I thought I’d be gone. I was ready to die because I felt for the brothers,” he added.

Oil bloc: We’ve not sighted any memo directing OML 11 take over – NNPC

By Daniel Adugbo

AgegePulse Magazine

The Nigerian National Petroleum Corporation (NNPC) said it has not seen any letter or memo from the Presidency instructing it to take over the operatorship of the entire OML 11 from SPDC, a local arm of Anglo Dutch oil major, Shell.

A memo had surfaced on Wednesday on  social media purported to have been signed by Abba Kyari, the Chief of Staff to the President, dated 1st March 2019 with a reference number SH/COS/24/A/8540 asking NNPC to take over the oil asset.

According to the memo, President Muhammadu Buhari has directed “NNPC/NPDC to take over the operatorship, from Shell Petroleum Development Company (SPDC), of the entire OML 11 not later than 30 April 2019 and ensure smooth re-entry given the delicate situation in Ogoniland.”

But NNPC spokesman, Ndu Ughamadu, told our reporter on Thursday afternoon that the NNPC was not in the know of such letter and could not make further comment on what it had not seen.

OML 11, said to be owned by four Joint Venture (JV) partners, lies in the southeastern Niger Delta and contains 33 oil and gas fields of which eight were producing as per 2017.

In terms of productiont, it is one of the most important oil blocs in Nigeria.
While NNPC owns 55 percent stake, Shell, the operator of the oil bloc has 30, Total 10 and Agip 5 percent.

“NNPC/NPDC to confirm by 2 May 2019 the assumption of the operatorship,” the memo further directed.
An SPDC spokesperson, Bamidele Odugbesan, declined comment when contacted on phone.

In the oil industry, an operator is typically the owner of the right to drill or produce a well. The operator will have the largest financial stake in the development of the project and will typically enjoy the largest share of profit.

Lagos, Kebbi, 16 Others Are Largest Rice Producing States As Nigeria Becomes Largest Rice Producer In Africa

From Nigeria being the world’s second largest rice importer years back, the narrative appears to have changed as the country continues to take steps to ramp up domestic production.

According to a recent report, Nigeria has overtaken Egypt as the largest rice producer in Africa. The Director-General, Africa Rice Center, Benin Republic, Dr Harold Roy-Macauley, who disclosed this, said Nigeria is now the largest rice producer at four million tonnes a year. Egypt was producing 4.3 tonnes annually but the country’s production had reduced by almost 40 per cent this year. Africa produces an average of 14.6 million tonnes of rough rice annually, he explained.

Indeed, the remarkable achievement recorded by the country in the area of rice production, as disclosed by Roy-Macauley, was the outcome of robust collaboration between the Central Bank of Nigeria (CBN) and the Federal Ministry of Agriculture, that focused on areas in the agriculture sector where the country has comparative advantage, in their quest to drastically reduce the country’s huge import bill.

A report by Lagos-based CSL Stockbrokers Limited showed that the central bank and the federal government have been making substantial efforts to encourage domestic cultivation of rice and to completely eliminate imports using incentives such as subsidised loans, cheap fertilisers, free farm land, and tax rebates.

Presently, the CBN has restricted importers of 43 items, which included rice, from accessing dollars from the interbank market and bureaux de change. Also, other fiscal policies are making it increasingly unfavorable for the importation of rice. Rice imports through land borders are restricted, while imports that come in through the ports attract sizeable import duties and levies.

Currently, 18 states are reputed as reliable rice producers in the country. They include Kebbi, Benue, Ebonyi, Ekiti, the Federal Capital Territory, Jigawa, Kaduna, Kano and Katsina.

Others are: Lagos, Nasarawa, Taraba, Kogi, Zamfara, Ogun, Niger, Kwara and Sokoto.
Clearly, these policies have led to a decline in imports and have resulted in significant rise in the price of imported rice.

Also, the CBN through its Commercial Agriculture Credit Scheme (CACS) as well as its Anchor Borrowers’ Programme (ABP) has continued to support genuine local rice manufacturers, in line with its development finance function.
